Tebogo completed his B Proc at Turfloop University (now University of Limpopo) and an LLB from Howard College at the University of Natal (now University of Kwa-Zulu Natal). Tebogo joined the firm as a Candidate Attorney in 1994 and was appointed as a Director in 1998. He became a member of the firm's Executive Committee in 2001 and was appointed Managing Director in 2005. Tebogo has served 3 terms as a member of the Executive Committee of the Pretoria Attorney’s Association and has on occasion lectured to black students as part of the Black Lawyers Association’s preparatory programme for Attorneys’ Board Exams. Tebogo has recently been appointed to serve on a sub-committee of the Johannesburg Bar Council charged with the responsibility of reviewing the criteria and procedure for the appointment of Senior Counsel.
Tebogo spends most of his practice time advising Boards, Statutory Councils and CEO's of statutory bodies as well as parastatals on all aspects of Administrative Law, the exercise of public power and the performance of public functions, major commercial transactions, PFMA and Treasury Regulations and Directives, corporate governance as well as restructurings. Tebogo also advises a number of corporate entities, given his world of experience in his advisory role to the Public Sector, in regard to regulatory requirements of commercial transactions, compliance with and interpretation of legislation. In this role he assists the corporate world in maintaining legal health given the dictates of the regulatory environment within which their businesses operate.
The key focus areas of Tebogo's practice include a full compliment of advisory services in the Public Sector on Administrative Law related issues including Corporate Governance, application and interpretation of the PFMA, re-structuring of State Owned Enterprises, structuring of commercial transactions and general Commercial Litigation including litigation centered on disputed tenders. He is also involved in legislative drafting and regularly attends to Review Applications and Administrative Law Litigation centered around the interpretation of legislation. Tebogo also offers clients a full spectrum of compliance and advisory services in the Healthcare Industry as well as other regulated industries such as the Financial Services and Insurance Industries.
Tebogo's most noteworthy recent transactions and matters handled are:
- He advised the Minister of Public Works and Council for Built Environment in regards to the revision of the Built Environment Professions Legislation. He also acted as the lead drafter for the Department of Public Works during the legislative process in Parliament as well at the Parliamentary Portfolio Committee hearings.
- He acted on behalf of a parastatal in an International Arbitration centered on defence contracts conducted under the auspices of the International Court of Arbitration in London.
- He acted as the team leader in a number of transactions in which the firm has been involved in regarding the re-structuring of state entities such as SITA, PRASA, SABS, MEGA, Land Bank, TIA, an agency of the Department of Science and Technology.
- He advised the Department of Water Affairs and Forestry regarding the disposal of the remainder of its forestry assets and the conclusion of a primary lease agreement between SAFCOL and the successful bidders.
- He advised both the Health Professions Council of SA and the Council for Medical Schemes on the 2007 amendments to the Health Professions Act of 1974 as well as the Medical Schemes Amendment Bill of 2007.
- He acted as pro forma complainant in the first successful perverse incentive prosecution of radiologists and referring doctors by the Health Professions Council of SA resulting in a reported judgment by the SCA on this type of ethical transgression.
- He acted as a team leader in the re-structuring of the Land Bank's insurance business.
- He defended a number of claims by foreign nationals and has conducted investigations on behalf of a Statutory Fund in Washington, Chicago and Seattle, USA, on a claim by a foreign national with a view to quantifying and defending the claimant’s R 100 million claim.
- He is currently acting as lead attorney for the Competition Commission in two compliant referrals in the plastic and telecoms industry.
- He currently acts as leader of the pro forma complainant’s team that is acting on behalf of the Health Professions Council which is prosecuting the first case of ethical transgressions involving the use of biological and chemical warfare. In this prosecution, the pro forma complainant’s team is assisted by a leading American expert in bioethics.
